DMB YACHTING GROUP — Website Terms of Use

These terms govern your use of www.dmbyachting.com (the “site”). By using the site you accept these terms. If you do not accept them, do not use the site.

The site is owned and operated by DMB Yachting Group Ltd, a company registered in England and Wales (No. 11550963), registered office: Ross House, The Square, Stow-on-the-Wold, Gloucestershire GL54 1AF.

1. Definitions

  • “We”, “us”, “our” — DMB Yachting Group Ltd.
  • “You”, “your” — any person accessing or using the site.
  • “Content” — all text, images, video, code and other material made available through the site.
  • “User Content” — anything you submit to the site, including registration details, CVs, briefs, testimonials and messages.

2. Intellectual Property

All Content on the site, including the DMB Yachting Group name and logo, is owned by us or our licensors and is protected by copyright, trade mark and other intellectual property laws. You may view and print Content for personal or internal business use. Any other use — including republication, modification, framing, scraping or commercial distribution — requires our prior written consent.

3. Acceptable Use

You agree not to:

  • use the site in breach of any applicable law (including the Computer Misuse Act 1990);
  • introduce viruses, trojans, worms or other malicious material;
  • attempt to gain unauthorised access to the site, its server, or any connected database;
  • harvest data, scrape content, or use automated tools to extract Content;
  • impersonate any person or misrepresent your affiliation with any person or organisation;
  • submit User Content that is unlawful, defamatory, obscene, harassing, or that infringes the rights of any third party.

We may suspend or terminate your access to the site, with or without notice, if we believe you have breached these terms.

4. Links

Links from the site. The site may contain links to third-party websites. We do not control those sites and are not responsible for their content, accuracy, security or availability. Following an external link is at your own risk.

Links to the site. You may link to the site provided you do so in a way that is fair, lawful, and does not damage our reputation or take advantage of it. We reserve the right to withdraw permission to link without notice.

5. User Content

You retain ownership of any User Content you submit. By submitting User Content you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display it for the purpose of operating our recruitment business and promoting the site. This includes the right to publish testimonials, anonymised case studies and quotes attributed to you, where you have provided them for that purpose.

You confirm that any User Content you submit:

  • is accurate and not misleading;
  • does not infringe the rights of any third party;
  • complies with applicable law.

We may remove or refuse to publish User Content at any time without notice.

6. Privacy

Your privacy and our handling of your personal data are covered separately in our Privacy & Cookies Policy. By using the site you confirm that you have read and understood that policy.

7. Disclaimers and Availability

The site is provided on an “as is” and “as available” basis. We make no warranties, express or implied, about the accuracy, completeness, reliability or suitability of the Content for any purpose. Information on the site is for general guidance only and does not constitute professional, legal or recruitment advice on any specific situation.

We do not warrant that the site will be uninterrupted, error-free, or free from viruses or other harmful components. We may suspend, withdraw or restrict the availability of all or any part of the site for operational or business reasons without notice.

8. Limitation of Liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded under English law.

Subject to that, our total liability to you arising out of or in connection with your use of the site, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited to £100. We will not be liable for any indirect, consequential, special or economic loss, loss of profit, loss of business, loss of data, or loss of opportunity.

10. Changes to These Terms

We may update these terms from time to time. The current version is always available on this page. Continued use of the site after changes are posted constitutes acceptance of the revised terms.

11. Law and Jurisdiction

These terms, and any dispute arising out of or in connection with them or your use of the site, are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any such dispute.


Applicants Agreement

This agreement governs your use of www.dmbyachting.com as an applicant, and our work placing you in seafarer roles. By registering or submitting a CV, you agree to these terms together with our Website Terms, Company Information, and Privacy & Cookie Policy.

You are contracting with DMB Yachting Group, Ross House, The Square, Stow-on-the-Wold, Cotswolds GL54 1AF, United Kingdom. Company number 11550963.

If you do not agree, do not use the site or engage our recruitment services.

1. Who this is for

You must be at least 18 and legally permitted to work as a seafarer in your jurisdiction. The site is for applicants seeking yacht crew positions and the employers we work with. Access may be unlawful in some countries — that is your responsibility to check.

2. Your CV and your account

You confirm that everything in your CV is accurate, complete, and yours to share. You are responsible for what you upload. We may amend formatting; you can correct or withdraw at any time.

You grant DMB Yachting Group a limited, revocable licence to use your CV for the purpose of placing you in roles. We may share it with prospective employers. Once an employer has seen your CV, we cannot guarantee they will not retain a copy — make withdrawal requests directly to them as well.

By uploading references, you authorise us and prospective employers to contact those referees on your behalf.

Your login is personal. You are responsible for keeping it secure and for any activity under your account until you tell us it has been compromised. Notify us immediately at the email on the Contact Us page if it is.

3. Statutory documentation

In line with the Maritime Labour Convention 2006 (MLC), we verify that the seafarers we place are qualified.

You agree to provide on request:

  • Certificates of Competency
  • STCW certification
  • Passport
  • Valid seafarer medical (e.g. ENG1)
  • References from prior engagements

If we place you with a client, you agree to send us a copy of your signed Seafarer Employment Agreement (SEA), or — where the yacht’s policy prohibits sharing — written confirmation from you that you have received, signed, and accepted it.

4. Our MLC commitments to you

DMB operates in accordance with the Maritime Labour Convention 2006 and ITF framework standards.

We commit to the following:

  • No fees to seafarers. You pay only for your own statutory medical, seafarer’s book (or Panama Book where applicable), and passport. We do not deduct visa costs from you.
  • No blacklists. We never use any mechanism to deter qualified seafarers from gaining employment.
  • Up-to-date register. We maintain a register of all seafarers recruited or placed through us, available for regulatory inspection.
  • Informed before signing. We explain your rights and duties under your employment agreement before and after signing, and you receive a copy on board.
  • Verified placements. We confirm you are qualified and hold the required documents before placing you.
  • Compliant agreements. We confirm your SEA meets applicable law and any Collective Bargaining Agreement that applies.
  • Complaints handled. We examine and respond to every complaint about our activity. See section 7.
  • Always reachable in an emergency. Director and consultant numbers are on the Contact Us page.
  • No exploitation. We do not engage in any transaction with a shipowner that promotes exploitation of seafarers.

5. Yachts on non-MLC flags

If a yacht does not fly the flag of an MLC-ratifying state, some MLC protections may not apply. Before accepting, ask for the owner’s documented obligations to seafarers and the conditions on board.

6. The Seafarer Employment Agreement (SEA)

There is no single standard SEA. Yours must meet or exceed MLC minimum standards when read together with any applicable Collective Bargaining Agreement. You are entitled to sufficient time to review it before and after signing, and to keep a copy.

The MLC sets minimum standards for hours of rest, accommodation, food, medical care, repatriation, wages, and onboard complaint procedures, among others. Where reasonably possible, we place applicants only with clients who have demonstrated the means to meet these obligations.

7. Complaints

Onboard issues. Follow the complaints procedure provided onboard the yacht.

Issues with DMB Yachting Group. Email us as quickly as possible at connect@dmbyachting.com. We will document and respond. If unresolved, we will escalate to the relevant flag state representative.

Escalation to the Employment Agency Standards Inspectorate. The EAS Inspectorate (part of the UK Department for Business and Trade) regulates recruitment agencies under the Employment Agencies Act 1973. If you remain unsatisfied, you can escalate:

DMB Yachting Group is not liable for damages resulting from action taken by us, or by a competent authority, to remedy a complaint.

8. Data and privacy

We process your data under the UK GDPR and Data Protection Act 2018. Full detail — including how long we retain your CV, your rights as a data subject, and how to make a request — is set out in our Privacy & Cookie Policy.

You can complain to the Information Commissioner’s Office (ICO) at any time.

9. Acceptable use

You must not use the site to upload viruses, malware, or anything that disrupts or restricts the operation of the site, and you must not attempt to gain unauthorised access to it or to other accounts.

10. Suspension and termination

We may remove your CV or suspend your account, with reasonable notice where practical, if (a) your account or CV breaches this agreement, (b) the CV is outdated, harmful, or unlawful, or (c) you breach any term here.

In the event of breach, or risk of breach, we may suspend access immediately without prior notice. You have no right to compensation for such suspension.

You can close your account at any time. These terms continue to apply to any conduct that occurred while your account was active.

11. Liability

We do not guarantee that using the site will result in employment. We use reasonable efforts to verify information but do not check every entry on the site.

Our liability for any direct loss arising from these Applicant Terms is limited to the amount of any fees you have paid to us; no fees are charged to seafarers, so this cap is nominal in most cases. Nothing in this agreement limits our liability for fraud, wilful intent, death, personal injury caused by our negligence, or any other liability that cannot lawfully be limited.

We are not liable for force majeure events outside our reasonable control, including acts of war, terrorism, strikes, pandemic, telecom disruption, hacking, or substantial software faults.

You agree to indemnify DMB Yachting Group against third-party claims arising from (a) information you placed on the site, (b) your infringement of a third party’s rights, or (c) your breach of this agreement — except where doing so would limit your rights under the MLC or applicable seafarer protection law.

12. Changes to this agreement

We may update this agreement as the service develops. Material changes will be notified to you in advance. Continued use after the effective date counts as acceptance.

13. Law and jurisdiction

This agreement is governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction.

14. General

If any clause is held unenforceable, the rest of the agreement still applies. Failure or delay in enforcing a right does not waive it. You may not transfer your rights or obligations under this agreement.

To provide effective recruitment services, we may forward your details to clients and prospective employers. You acknowledge that your profile information is made available to registered employer clients for the purpose of identifying suitable employment opportunities, in accordance with our Privacy Policy and UK GDPR.

5. Data protection

Personal data submitted via this site is processed under our Privacy & Cookie Policy.
